A strange incident involving a drink container at a baseball game has now turned into a legal battle for the Los Angeles Dodgers. A woman from North Carolina has filed a lawsuit against the team after she says she was injured during a game at Dodger Stadium when a BuzzBall alcoholic drink container struck her in the shoulder. The case centers on an incident that allegedly took place during a Dodgers game last August while she was visiting Los Angeles with her family.
According to Brobible, the complaint filed in Los Angeles Superior Court states that the woman claims the container came from above her seating area. She alleges that someone either tossed it, dropped it, or otherwise sent it falling from a higher section in the stadium before it hit her. The container, known for its round shape and roughly baseball-sized, allegedly made direct contact with her shoulder.
In the lawsuit, she describes the impact as serious enough to cause immediate injury. “struck her directly in the shoulder with significant force.”The woman claims that the moment the container hit her, she began feeling pain right away. She says the blow led to bruising and swelling in the area and ultimately affected her ability to use her arm normally. According to the legal filing, the injury did not just cause temporary discomfort but interfered with her ability to move her arm as she normally would.
The Woman Is Representing Herself
What was supposed to be a memorable vacation quickly took a turn for the worse after the incident. The woman had traveled to Southern California with her family and had planned to spend several days enjoying the area. One of the highlights of the trip was meant to be a visit to Disneyland along with other sightseeing activities. However, she claims the injury she suffered at the baseball game disrupted those plans and significantly impacted the trip.
“As a direct result of the incident, plaintiff’s planned four-day family vacation to Los Angeles and Disneyland was substantially disrupted and deprived of its intended enjoyment.” Her complaint also describes the emotional impact the situation had on her children. According to the filing, her two young kids were present when the incident occurred and saw their mother get injured.
The lawsuit states that the children experienced “fear, shock, and emotional distress” after witnessing what happened to her. Beyond the injury itself, the woman argues that the Dodgers, who are preparing for their title defense, are responsible because of how the beverages are sold and served at the stadium. She accuses the team of negligence and claims that allowing drinks to be served in containers that could easily be thrown or dropped from higher seating areas created a potential safety hazard for fans below.
In the complaint, she claims the team should have recognized that selling alcohol in containers that could be tossed or accidentally dropped from elevated areas posed a danger to spectators. Specifically, the lawsuit argues that serving alcohol in “containers capable of being thrown or falling” created “a foreseeable risk of harm to spectators.”
The woman says this situation created a dangerous environment for fans attending games. She also alleges that the Dodgers, who recently acquired Kyle Tucker, did not take sufficient steps to prevent incidents like this or warn fans about the potential risk.
As part of the lawsuit, she is seeking financial compensation for a range of damages related to the incident. Those include physical pain, emotional distress, loss of enjoyment of her trip, and medical costs tied to treating the injury. The complaint also mentions both past and potential future medical expenses connected to the shoulder injury.
She is also asking that the case be heard by a jury. In the legal filing, she requested a “trial by jury on all issues so triable.” For now, the Dodgers have not offered any public comment about the case. A team spokesperson indicated that the organization does not discuss ongoing legal matters, which is standard practice when litigation is involved.
While unusual, incidents involving objects falling or being thrown from higher seating sections are not unheard of at large sporting venues. However, the lawsuit raises questions about stadium safety and how teams manage risks tied to food and beverage service during games.
