We have become confused with companies buying other companies, brands "owning" other brands. You're right....that doesn't describe Madden perfectly or anything. Businesses are, indeed, not stupid. They know using terms like "exclusive" allows them to leap through massive legal loopholes and by categorizing their products accordingly, they can avoid specifying their good, thus more easily being able to point to potential "viable substitutes".
