Lead attorney Steve Berman gave this quote about the situation:
There is nothing wrong with good, strong competition in a free market, but we believe EA rigged the game to take advantage of consumers.

EA knows that the demand for these games is based on how realistically the players and teams are portrayed. When EA signed into exclusive agreements it knowingly killed the only competing game of comparable quality, [Take-Two's] NFL 2K5.

As much as I would love for EA to lose exclusive rights, that lawsuit is a joke and will not even be a blip on EAs radar.

Im not 100% sure, but can someone tell me why the NFL goes along with that deal? I dont know all the facts about it, admittedly, but it seems to me that more NFL games would bring them in more money. Like I said, that may not be true...I dont know.

I just dont want to have to wait until Im in my mid 30s before I play a NFL game that makes me go "Wow" like MLB the show and Fifa do.

lol..crazy stuff.

I mean...if company A gets the chance to get the licence for product X exclusivly, they will get it by any means in order to have an advantage to their competitor,company B.

You can fill in ANY company for A,B and nearly any relevant brand in X.

What's the point in sueing EA? The NFL signed the deal, doesn't matter which side made the offer.

Just a PR related thing,IMO.

I think you would have to sue the license owner, not the licensee...


And good luck suing the NFL when they got anti-trust protection.



If Arlen Spector survives this coming election, he'd probably be the ONLY guy in the Senate who would champion the cause.

Probably because John Madden is the reason we even have a football game. When everyone else was putting out ****ty football games Madden was making it good, plus John Madden is like a huge part of the NFL from Coaching,Announcing, Video Games.

With that being said though EA has done a GREAT job on Madden 10 dont get me wrong, but they shouldnt forget their roots and realize competition brings out the best of everyone.

I'm certainly not defending the exclusivity of the deal by any means as I'm all about competition as well (has worked out wonderfully for soccer fans), but EA really isn't the party to blame here. The NFL doesn't "go along with it" as you suggest. They are the ones who initiated the deal. At the time, they felt that EA was the highest quality video game maker out there and wanted to make sure their league was represented in a good light. The NFL has exclusive licensing deals all over the place. Just ask any cable customer who can't get the Sunday Ticket

While it sucks that EA is the only NFL game maker for those who'd like to have options, it's the NFL's license to do what they want with. And they chose to have EA make video games that represent their league. End of story.
