If it's a violation of its own bylaws that's at issue, then these board members should be suing the Board as a whole for any violations and/or breach of fiduciary duty. But until and unless PSU through the Board challenges the validity of the consent decree officially, I don't see what recourse individual members will have. I'm curious to hear their argument.

Exactly. Makes no sense. The NCAA has already said the Freeh report was far more in depth than anything they could have done. For $6.5 million is should be.

Not to mention PSU paid for this report.

Omg...Can they just let it die. They just need to let it go, it's best for the University and more importantly all those victims(not that they are directly involved in the suit/appeal but they are associated with the scandal)

Re: Penn State BOT to Appeal NCAA Sanctions

PSU former players are appealing the vacated wins. They even say that many of the findings in the Freeh Report are not supported by evidence. I just don't get it PSU, shut up and take your punishment, it will allow people to forget sooner. NCAA please just ban PSU until all lawsuits are settled.

Quote:
http://espn.go.com/college-football/...ncaa-sanctions

A group of former Penn State players, led by former quarterback Michael Robinson, has notified the NCAA that it intends to appeal the harsh sanctions placed upon the football program for the Jerry Sandusky child sex abuse scandal.

Paul V. Kelly, an attorney for former Nittany Lions quarterback Michael Robinson and seven others who played for Penn State at some point during the 14 seasons in which the NCAA vacated victories, sent an intent to appeal letter (PDF) to the NCAA dated Aug. 7.
......
"The Appellants challenge the factual findings and conclusions of the consent decree and of the underlying investigative report by Sporkin & Sullivan (the "Freeh Report"), which -- without notice, investigation or hearing as required -- provided the predicate for the actions taken by the NCAA in this matter."

The letter says many of the findings in the report "are clearly erroneous and not supported by the evidence."

"By these unsupported findings, the Appellants have been forever branded as somehow contributing to a 'culture' on campus that enabled these unlawful acts against children to continue. Meaning no disrespect to the victims of abuse, these findings are unfair and they are wrong."

You all know that guy that needs to learn how to end his stories one sentence earlier? Yea, Penn State is that guy. It's time to just be quite for a bit.

If anything, I agree with the players appeal more. The BOT is just dragging this on, but I can't be upset for players appealing the wins. They certainly earned those wins and I see why they are upset.

They won't win the appeal (and I don't think they should), but I see where they are coming from.

I am not misinformed. The NCAA gave a certain person the sole choice on punishment, and that man was not Louis Freeh. That's where the problem could come into play.

Re: Penn State BOT to Appeal NCAA Sanctions

I agree with everything the NCAA did except vacating all wins since 1998. It makes no sense since the scandal had nothing to do with how the team performed on the field.
