Although the penalties were probably too severe, I think the NCAA was making an example out of Penn State. If something like that could happen at such a revered and respected university who knows what else is going on around the country, you know?

I don't see too much of a problem here. Some members of the BOT disagree with the sanctions. Is that unreasonable? No. There is no harm in appealing a decision. But of course this will be a much bigger story than this needs to be.

But they aren't simply disagreeing, and it sounds like they are willing to try and go to court without the support of a majority of the board. This is a story of their own making. If they only wrote a letter voicing their displeasure, I would agree it's a non-issue. But their actions here show these board members are prepared to make it one.

Do you honestly expect anything to come from this though? I would've been surprised if they didn't appeal. However, like I said, I don't think they'll win. And I agree that it is dragging it on a bit. But I don't think this is a big story.

It's the threat of litigation that makes it a story. If the courts dismiss the case and the board members give up immediately, it won't be much of a story. If they drag this out and don't let go, it will be a big story.

Oh, I don't doubt that. I was just saying that it shouldn't be that big of a deal, in my opinion. It'll be interesting to see where this goes.

IMO, if it actually gets to court, I can see them actually winning the case on the basis that no NCAA rule was violated and therefore the NCAA had no jurisdiction.

In that case, the NCAA could not just give them another punishment. If that were to happen, I'm not sure it wouldn't actually be worse for PSU's reputation.

Actually, they sent a letter to the BoT demanding that they file this motion last week. So they did have some influence here.
