While the two for one argument does have merit, your appeal is denied on the basis of the one photo, which does away with the hot mental image. A second photo would not help to undo the damage of the first photo.

Yes, the "hot" is being used in an ironic manner, but not in the realm with you are suggesting. In most instances, a child molester is considered a man. There are numerous instances of this throughout history, with "Chester the Molester" being a well known example. However, to limit the definition of child molester to just men would violate the ruling set forth in Yick Wo v. Hopkins. Therefore the play on words is used to have the reader think one thing (no male molester can ever be considered "hot") but find out it means something else once reading the thread ("hubba, hubba" re: Roth v. United States, also FCC v. Pacifica Foundation). With this in mind, the title is far from ambiguous, as the opposition would like you to believe.

As for the argument that prior offenses have not been punished in a likewise manner, we would like to court to take into account McCulloch v. Maryland, which indisputably established that the US Constitution is the supreme law of the land. There is nothing in the Constitution that forbids one act from being punished, even if it can be shown that similar previous acts went unpunished. At this point, we cannot state that previous posters of ugly teachers did not receive a grant of immunity, thus invoking Kastigar v. United States.

Sarah L. Tolzien, 24, of Arlington Heights, was charged Tuesday after a five-month investigation, Matteson police said. Her bail was set at $10,000 Wednesday and her next court hearing is April 15 at the Cook County Courthouse in Markham.

Tolzien, who teaches English and coaches the boys varsity cross country team at Rich South High School in Richton Park, was placed on administrative leave Dec. 1, police said.

Police were contacted Dec. 1 by the victim's parents, who reported their teenage son might be having a sexual relationship with his cross country coach.

McALLEN — A woman who police say slept with her son's 15-year-old friend has been jailed on sexual assault charges.

Ana Luisa Perez, 33, was arrested Tuesday and charged with three counts of sexual assault.

During a March 24 interview, the teenage boy told police he had sexual relations with Perez between October and December 2008. Their first sexual encounter was at Perez's house "when everyone else was asleep."

McAllen Municipal Judge Charlie Ochoa arraigned Perez on Tuesday. He set her bond at $120,000 for three counts of sexual assault of a child, a second-degree felony punishable by up to 20 years in prison upon conviction.

Perez remained at the Hidalgo County Jail late Wednesday afternoon.

EDINBURG — A school bus driver has been suspended without pay following allegations she had sex with a student, officials said.


The parents of a 15-year-old high school student told Edinburg school district officials Friday that their son was having sexual relations with bus driver Ana I. Gonzalez, 30. The pair allegedly began having sex two months ago, Edinburg school district attorney Jacques Treviño said.


Treviño said the school district is looking into the allegations while the Hidalgo County Sheriff’s Office conducts its own criminal investigation.


“Once the investigation is concluded, we will consider a possible termination,” the attorney said. “We do not tolerate that type of behavior from any of our employees.”
Treviño said the woman, along with every other transportation employee at the district, had attended a mandatory sexual harassment awareness seminar over the summer.
“There can’t be any excuse of there not being proper training,” Treviño said. “We have a very strict policy and state laws” against inappropriate behavior with students, he added.

Gail E. Gagne, 27-year-old granddaughter of wrestling legend Verne Gange and daughter of Greg, is being charged with two counts of felony third-degree criminal sexual conduct. This according to a criminal complaint that was filed on Wednesday, December 2 in Hennepin County District Court in Hennepin Country, Minnesota. A warrant has been issued for her arrest as she is believed to be out of state, presumably in the Chicago area.

Gagne is accused of having engaged in an affair with a male student during the summer of 2008. Gagne, 25 at the time, was the weight room supervisor at Cretin-Derham Hall and the student was at the time 16. The complaint noted that the two had numerous sexual encounters during that time, instances occuring at her home in Bloomington and later at a hotel near the Mall of America. Her credit card records show she also used a room at La Quinta Inn & Suits in Bloomington September 13 and 14, 2008.

St. Paul police became aware of the situation on May 4, 2009 when they were called to the school. On May 11, the school’s principal sent out a letter to parents stating that they had taken “immediate action and followed our policies: The staff person was put on leave, and the proper authorities were notified.”

“The student was protected and offered any support or counseling that the school could provide,” Tim Thornton, attorney for Cretin-Derham Hall, said in a statement issued on Thursday, December 3. “An independent investigation was promptly conducted and appropriate personnel action was taken. CDH remains ready to provide any assistance needed by the alleged victim. Besides that, CDH stands ready to cooperate fully with the pending legal proceedings.

“”Finally, the administration and the faculty deeply regret any impropriety that might have happened. CDH now awaits the outcome of the criminal justice system and trusts in that process.”

Investigators arrived at Greg Gagne’s house in Bloomington recently looking for her, but he informed them that she had moved and was working out of state. Greg has since declined to comment further on the situation. St. Paul police spokesman Janet Dunnom noted that Gagne may have relocated to Chicago, but the information has yet to be verified.

“She’s going to come back and respond to the case,” Earl Gray, Gagne’s attorney, said. He added that she would be entering a not guilty plea and will go to trial.

No court date has been set. Both charges Gagne is facing are felonies that are punishable by up to 15-years in prison for each.

According to Section 609.34x of the Minnesota Criminal Code, the legal age of consent in Minnesota is 16. However, the age of censent is 18 if the actor is in a position of authority.

A nude photo of a Bangor Area School District teacher’s aide has been circulating among the student population, reports lehighvalleylive.com.
Someone took the young woman’s cell phone, which had a naked picture of her on it, and then forwarded the photo to everyone on the aide’s contact list, says school board member Ron Angle.
District officials notified parents of the situation in an automated phone message, asking the parents of student in grades 7 and up to check their kids’ cell phones for the image.

Heh. After finding out whether the teacher is hot or not, I always wonder if the kid they're messing around with is the typical good-looking type or the more geeky type who would be spending a lot of time after school with teachers normally.

I don't know what the kid in question in my story looks like but I do know that he is (allegedly) a junior that plays football. Or at least that's the person my niece and the rest of the students are convinced was involved.

The exclamation/question that titles this post is my initial response to this remarkable local press story that a helpful student sent my way. This press report discussed a remarkable local sentence handed down earlier this week in Nevada under the headline "T.F. woman sentenced to life for lewdness charge." Here are the remarkable details:
A Twin Falls woman convicted of forcing a 13-year-old boy to touch her breasts was sentenced Monday to life in prison. Michelle Lyn Taylor, 34, was convicted of lewdness with a minor under 14 in November after a week-long trial in Elko County, Nev., District Judge Mike Memeo’s courtroom.

With the conviction, Taylor faced a mandatory life sentence, and Memeo set parole eligibility after 10 years, the minimum sentence. If released on parole she must register as a sex offender and will be under lifetime supervision.

The district attorney’s office did not offer a plea agreement in the case, said public defender Alina Kilpatrick, who argued the sentence is unconstitutional and doesn’t fit the crime. “The jury was not allowed to know the potential sentence in this case and the Legislature doesn’t know the facts,” she said, alluding to the minimum sentence set by the Legislature in Nevada Revised Statute.

Kilpatrick said despite the parole eligibility after 10 years, there should be no mistake that it’s a life sentence for Taylor. “She is getting a greater penalty for having a boy touch her breast than if she killed him,” she said.

After he sentenced her, Memeo said he was bound by state statute to impose the life sentence, but said he isn’t sure why the prosecution chose to charge her under that statute. District Attorney Gary Woodbury could not be reached for comment.

Taylor, who lived in Jackpot, Nev., at the time of the crime, kissed a friend’s child, forced him to touch her breast and asked him to have sex with her in February 2008. Taylor claimed she was intoxicated and doesn’t remember what happened that night. She told jurors she roughhoused with the boy, but didn’t force him to touch her inappropriately.

Based on the facts stated here, this case sounds like a remarkable test case for the reach and limits of the Eighth Amendment in non-capital punishment settings. But I cannot help but think there must be more, perhaps a lot more, to this story.

I'm all for protecting kids and locking up sexual predators and child molestors for good, but that seems like a bit of a stretch in this case given that there was no actual genital contact.

Personally, the reform that I would love to see is juries being instructed of the sentence to which the defendant will be exposed upon a finding of guilt. If this jury had known that a guilty verdict meant life in prison, I doubt that they would have convicted. Which means that the prosecution would have had an incentive to prosecute this case under a statute without a mandatory life punishment.

It's the same situation as the Georgia High School football player, I believe the Georgia Supreme Court eventually struck it down after a few years due to the fact that the legislature changed the law not too long after the sentence was imposed (though they didn't apply it retroactively) and it violated the 8th amendment...I think that's what happened anyway.

The boy’s mother agreed to the plea deal in order to avoid her young son having to testify in open court.

Lafave was sentenced to three years of Community Control (house arrest) and seven years of probation.

On December 8, 2005, a second judge failed to accept the plea agreement because of the lack of prison time and set a trial date for April 10, 2006, but the prosecutor in that case later dropped the charges.

The story took a bizarre twist after John Gillespie, the lead detective, was arrested before the trial in an unrelated prostitution sting, while Tampa Bay Police officers were probed when it was revealed they took graphic nude photos of Lafave while she was in stirrups in a jail cell.

Lafave went on national television to explain her actions, attributing her indiscretions to bipolar disorder, hypersexuality and poor judgment during manic episodes.

Her first husband also appeared on numerous talk shows regarding how his then-wife's crime had affected their relationship.

When a patrol officer found a high school teacher in a parked car with a 16-year-old student, both were naked and there were bottles of Sprite and vodka in the car, according to the arrest affidavit.

Mountain View High School instructor Courtney Bowles, 31, bought the booze, picked up the unnamed boy and parked her blue Subaru in North Lake Park around 10:40 p.m. Friday, the reports shows.

The alleged victim first said he had no identification with him and gave Loveland Police Officer Sharon Hopkins a false birth date. When she questioned him again, he handed over his Mountain View school ID, showing he was a 10th grader. He then acknowledged that he was only 16.

Bowles, who's married with two children and is an instructional coach for teachers at the school, told the officer that she offered the boy alcohol, but he only had one sip.

Bowles, arrested for sexual assault by a person in a position of trust and contributing to the delinquency of a minor, was released on a personal recognizance bond Monday.

The 8th Judicial District Attorney's Office is expected to file charges by Thursday.

Though Bowles is out of custody, a judge has ordered her to stay away from anyone younger than 18, to remain 100 feet from the high school, and to refrain from contacting the boy or his family.

"In the initial investigation that led up to the filing of the charges, there was only one victim that was indicated," said Sgt. Benjamin Hurr, spokesman for the department.

Her work at Mountain View included instructing teachers on how best to interact with students, though she also tutored kids struggling in their studies.

In the wake of Bowles' arrest, Principal Kevin Aten sent out a notice encouraging parents to speak with their children about the incident and report any other suspected abuse to school officials.

"We are fully cooperating with the Loveland Police Department's ongoing investigation," the notice said. "We are also concerned that there may be other victims."

MASON — A female Mason high school gym teacher is accused of having sexual misconduct with five students, most of them football players at the school.

A Warren County grand jury on Friday indicted Stacy Schuler of Springboro on 16 counts of sexual battery, a third-degree felony; and three misdemeanor counts of offenses involving underage persons.

Schuler, who will turn 33 next week, allegedly had sexual contact with the students on five different occasions between August and December, according to officials with the Warren County Prosecutor’s Office. She also allegedly bought alcohol for the students, according to the indictment.

Prosecutors said the alleged sex acts, mostly with football players at Mason High School, occurred off school grounds.

Chief Assistant Prosecutor Bruce McGary said the allegations did not happen at a party. Mason police Detective Toni Hoelke said when the parents of the students found out about the allegations, they “were surprised and that they had no idea about it.”

Schuler, who is single according to prosecutors, turned herself into authorities Friday and was arraigned in Warren County Common Pleas Court.

Her bond was set at $50,000 and was ordered to stay away from the victims as well as any other students. On Friday night, she had not posted bond.

Teresa Engelbach was a substitute teacher and volunteer track coach at Senn-Thomas Middle School who was arrested in November of 2007 after charges that she had sexual intercourse in multiple locations over a two month period wih a 14-year-old student, a friend of Engelbach’s brother. According to authorities, she also bought the boy various gifts, including a cell phone, items of clothing, and a paintball gun worth $750. She initially pleaded not guilty to the charges, but in March of 2008 entered a guilty plea to one felony count of second-degree statutory rape and one misdemeanor account of of sexual misconduct. She was sentenced to two years of probation, and required to register as a sex offender.

Pretty sure I never heard the word "gangbang" until I went to private school in high school, but I knew what "running a train" was when I was around 9 or 10 years old.
