MassNole's Rantings
Sunday, December 14, 2008

Then I checked the mail yesterday, to find out I have to be in Court on Monday, December 22, at 9am. Now I am really pissed off about this, not so much because I have to be in Court, but because the other attorney didn't bother to call me to try and schedule this, and furthermore this is for either a completely frivolous reason, and/or because there is something very illegal and unethical going on behind closed doors. I am leaning towards the latter. Either way it destroyed my Christmas plans because no one bothered to give me the common courtesy of a simple phone call to say "Attorney MassNole, we need to the Judge to handle something, what's your schedule look like to get this in?"
When we are first entering the profession, we are constantly told to show the utmost respect for the other attorneys. To consider our reputation and to be courteous and respectful in all of our interactions with both the court and fellow attorneys. Fair enough, but no, I don't give out respect until is earned. And this is the second attorney this week I have dealt with this week who showed me absolutely no respect whatsoever. Both work for State agencies, and I am befuddled as to how. The first showed me she can't interpret case law with any more skill than that of an illiterate retard and had the gall to tell me I was dead wrong about a case and it's application. (Court said to treat each case individually on it's individual facts and merit, literally said this, her stance, it gave blanket authority for all matters). The second is grossly abusing the power of her office, and my gut is screaming something else is going on behind the scenes (I can't say what without violating privilege).
The bottom line today, law school is much more competitive to get into than it was 5-10-20 years ago. The LSAT is more competitive and the same raw score today would have been 10-20 points higher years ago (when both of these attorneys would have taken it). Meaning those of us graduating now, did so in a more competitive environment than our predecessors, yet we get no respect or common courtesy, but are expected to blindly give it to our elders. Give me a break, because of a clear lack of respect, I had to cancel my Christmas plans with my mother (she works Wednesday-Saturday, 1pm-11pm). Yet by virtue of her being older I should respect her? No, just no.
She was the one who made the call to bring a case with no merit to court. It is not my fault I was able to blow that case up in Court (and this was my first trial, wait until I have experience and see how fun that will be) and made her witnesses look bad on the stand. I did my job, the Judge sided with us without the need for closing arguments. I can't believe the Judge is going to be much more amused to be there next Monday than I will be.
Okay, rant over.
